A Harvard Law School faculty member since 1964, Dershowitz is noted for representing controversial and unpopular clients. In addition to tomes on the law and two novels, he wrote a 1987 book prescribing a remedy to save American Jews (The Vanishing American Jew). In this further demonstration of his versatility, he turns to 10 stories from Genesis to demonstrate how the Bible provides a basis for contemporary ideas about justice and injustice. The narratives deal with Adam and Eve, Cain and Abel, Abraham, Lot, Jacob, Dina, Tamar and Joseph. Dershowitz includes a translation of each story, recounts some theological commentaries and offers his own interpretations. He acknowledges the failings of the biblical characters, pointing out that they were guilty of deception, lust, crime, incest, revenge and murder. Their problematic actions highlighted the need for the laws that appear later in the Torah, starting with Exodus and the Ten Commandments. The book concludes with four chapters on "The Genesis of Justice in the Injustice of Genesis." Dershowitz argues that the "bad actions" depicted in Genesis gave rise to the "common law of justice." He addresses the question of theodicy, claiming that the belief in the hereafter solves the problem of why evil exists on earth. Finally, he asserts that the stories he has examined explain the need for judicial codes. The book makes an important contribution by clearly validating this claim, although Dershowitz disregards the stories' significance as a basis for moral and ethical development. (Mar.)

Harvard law professor Dershowitz has written a dazzling and stimulating commentary on ten Old Testament stories and how they provide the origins for today's laws. In a familiar style that evokes being in a small seminar with the professor, Dershowitz takes ten biblical stories, including those of Adam and Eve, Cain and Abel, and Lot, and offers multiple views on their application today. His view is that the Book of Genesis reveals the origins of justice in society. Ranging over such topics as the insanity defense, police corruption, federal sentencing guidelines, and the defense of the guilty, the book provokes the reader to consider God's fairness as well as that of our current justice system. In the best Socratic tradition, Dershowitz (Reversal of Fortune) asks many questions and provides multiple scholarly and commonsense views of the lessons to be learned from the biblical tales. He ends the book with a discussion of the Ten Commandments and shows how they can be traced to the stories of Genesis. For believers of all faiths, as well as nonbelievers, this is an outstanding work.

In his new book, the author of, most famously, Chutzpah (1991) argues that the quest for justice is the main theme of the Bible's first book. The subsequent books of the Pentateuch are much fuller of actual rules and regulations, beginning with the Ten Commandments, but the process that culminated in them is the gist of Genesis. Dershowitz re-presents 10 stories, from the fall of Adam and Eve to the saga of Joseph and his brothers, and discusses the crucial midrashim, or rabbinic interpretations, made about their import relative to justice. Dershowitz does not merely summarize old opinions and arguments; he adds evidence and lessons from his own law practice to point up the stories' continuing relevance to the practice of justice today. Overall, he shows that there are two distinct developments. First, God grows in understanding of humanity and changes his mind about how to deal with his creation, nowhere more strikingly or with greater implications for justice than when he lets Abraham convince him to spare the few righteous in Sodom and Gomorrah from his destruction of those cities. Second, justice increasingly, though never unequivocally and completely, becomes concerned with individual persons' guilt and innocence rather than collective guilt. And what quality of the Jews enabled them to drive those developments? Why, that tireless assertiveness known as chutzpah--of course. Ray Olson

If History Begins in Sumer, Law Begins in Genesis...

from the first book (Genesis) of the five books of Moses (Torah) from
the perspective of law and justice. Based on Torah, Talmud, rabbinic
commentaries, the Hasidic commentaries of Rabbi Levi Isaac of
Berditchev, and the legal insight of a yeshiva educated Harvard law
professor, the reader follows the development of the concept of
justice. Consider the flawed personalities in the Book of
Genesis... it's like watching 5 seasons of Law & Order: Adam and
Eve (expulsion); Cain and Abel (murder and favoritism); Noah, Abraham
and Isaac (attempted murder, the akedah), Hagar and Sarah; Abraham,
Sodom and ten good people (collective punishment?); Esau and Jacob
(bait & switch, verbal contracts and trickery); Jacob and Laban;
Hamor, circumcision, and Jacob's sons; Joseph and his
brothers. Dershowitz provides an enlightening read and ready access to
commentaries that remove the rose-colored glasses from the stories you
heard as a child.

thoughtful, repetitive interpretation of origins of justice

It pains me to write an unflattering review of "The Genesis of Justice," as I admire both the integrity and intelligence of its author, Alan Dershowitz. Professor Dershowitz is at his best in descriptive analysis; he dissects ten stories from the book of Genesis in his attempt to prove his essential thesis: the Bible "uses stories of injustice to teach about the need for justice." If you judge "Genesis" by that standard, he has succeeded admirably. Dershowitz is a talented and prolific writer; his style is graceful and his arguments are exquisitely prepared and developed.
However, a discerning reader ought expect more than biblical exigesis and patterned presentations of pro and con arguments about the stories selected. This volume reads much more like a series of interrelated, independent magazine-length stories than a comprehensive treatment of his selected thesis. By book's end, the reader can almost anticipate heavily repeated phrases to appear once and again. Sadly, his final four chapters seem almost to appear as a post-script rather than serve as a stirring summation of the understandings gained through synthesis and interpretation of the book of Genesis.
Lest I appear disrespectful of Professor Deshowitz's efforts, I must praise his own passion for justice. His obvious quest for understanding, for combining a search for truth, understanding and retribution make this work an important philosophical keystone for anyone who hopes to understand how our culture reflects and aspires towards the ideals of justice articulated in the Bible. His own admonition that justice is a state never achieved but constantly sought after is both a warning and a call to action. "The Genesis of Justice," though flawed by repetitions and poor editing, is an important contribution to both our understanding of the Bible and our hopes for justice.

A Good Introduction to the Bible

Since my days as a child in Sunday school, I never paid much attention to the Bible. And as an adult, it never made that much since to me. After reading The Genesis of Justice, I now know why. I found violence glorified and deception affirmed. Dershowitz finds it necessary to clear up some of the inconsistencies in the Bible. He further introduces logic to obscene narratives that to me were always mere ribaldry. Hence my discontinuance of reading the Bible, especially to my children when they were younger. What is interesting, however, is Dershowitz's main premise. He argues that the root of today's judicial system lies in the Book of Genesis. He says that from Genesis we learn that actions and reactions derive from the nature of human beings and their Creator-not from formal codes of conduct. From that, I was left to wonder why are deterrence mechanisms set in place. Why the death penalty? Why prison sentences?
If Dershowitz makes this required reading for his freshman law students -he will inevitability produce a group of reactionary liberals who will challenge the system-or not. It is just that pendulous. One could go either way when analyzing the narratives in Genesis. He reprises some interesting questions - Do you punish someone if they are ignorant of the law or of right from wrong? Do we punish a whole community to get to the evil few? Is it okay to commit a crime if it is a matter of life and death?
Dershowitz assumes that whoever reads the book is well-acquainted with the Jewish interpretations and speaks to the reader as though you are on familiar grounds. Yet it is still an easy read. You enjoy his references to other rabbi's interpretations. The book has copious footnotes and the notes alone are informative. Dershowitz did a fine job in demonstrating how nothing comes from nothing...how laws have developed from a culmination of a long process of developments. The Ten Commandments, he argues, didn't just appear fully formed from the mountaintop - they were generated and came about because of events from the past or I should say events from the beginning.
